Anna Bicarregui

Anna has been a member of chambers since 2005. She practises in all areas of public law, with particular emphasis on education, employment and local government law.
Education Law
Anna has particular experience in education law. She appears regularly in SENDIST (now the Health, Education and Social Care Chamber of the First-tier Tribunal), in both statementing cases and discrimination cases. She has a good record of successfully defending discrimination claims.
She advises on all areas of education law, including issues such as special educational needs, disability discrimination, admissions and exclusions. Anna currently has a number of cases pending before the Upper Tribunal, including a case which should clarify the vexed issue of margin or additional cost in SENDIST cases which turn on the issue of ‘unreasonable public expenditure’.
Anna regularly provides training sessions for local authorities on special educational needs and discrimination.
Employment Law
Anna has wide experience of all areas of Employment Law ranging from standard unfair dismissal cases, to more complex TUPE and discrimination matters and has a high rate of success in the Employment Tribunal. She has acted in a number of lengthy discrimination cases, including claims of associative disability. Anna regularly advises employment solicitors acting for both individuals and large and small employers.
Anna has developed a specialism in education related employment matters. She has acted in a number of cases for schools and local authorities defending discrimination claims and recently acted for a local authority defending its decision not to confirm the induction period of a trainee teacher before the General Teaching Council.
Anna is a member of the Employment Law Appeal Advice Scheme providing specialist advice and representation at the Employment Appeal Tribunal. She currently has a number of cases pending before the Employment Appeal Tribunal, including a potentially far-reaching case for local authorities on the issue of whether foster carers are ‘workers’ and hence may be subject to the Working Time Regulations 1998 and national minimum wage legislation.
Local Government Law
Over a number of years, Anna has provided advice to local authorities on a wide range of public law issues including community care, mental health, data protection and environmental protection. She has been involved in a number of judicial review cases representing local authorities.
Data Protection/Freedom of Information Law
Anna has a particular interest in data protection and freedom of information. During a one year sabbatical in a law firm in Brussels, Anna advised on this area of law from a European perspective. Anna will be contributing to the new edition of Philip Coppel’s Information Rights textbook.
