Charles Foster instructed in urgent out-of-hours medical treatment Court of Protection case, now on appeal to the European Court of Human Rights in Strasbourg.

Charles Foster, instructed by Camerons, appeared for the relative of a patient who had suffered a cardiac arrest in November, and who was being maintained on artificial feeding and hydration. The Court of Protection had previously decided that it was not in the patient's best interests for his feeding and nutrition to be continued and the Court of Appeal had refused to interfere. The case was appealed to the European Court of Human Rights. At a hearing on 28 December 2020 Mr Justice Holman, sitting as an emergency judge in the Court of Protection, decided that the feeding and hydration should be reinstated until the case could be revisited in a full hearing by the Court of Protection. The case was heard in the Court of Protection on 30 December by Mr Justice Cohen , who ordered that feeding and hydration should now continue until 7 January - pending a decision by the Strasbourg court as to whether it will accept the case.
