Satinder secured a full strike out where the value of the case presented was to exceed £1million and when liability had been admitted.
The claim arose from an electrocution injury on the grounds of fundamental dishonesty. The circumstances of the injury were considered dubious, with a minor injury expected at most.
The Claimant, whose case was severely undermined by the use of covert surveillance evidence and supporting medical evidence, claimed grave consequences including an inability to work and the need for ongoing care and support.
This case is to be contrasted with those where substantial injury has been sustained and fundamental dishonesty as to part of the claim has been established, but to strike out the claim in its entirety may be unjust.
Satinder was able to demonstrate that wholesale exaggeration as to the nature and extent of the injuries and their consequences had taken place.
