Jayesh Jotangia successfully assists with Plastic Surgeon’s General Medical Council’s (GMC) CESR appeal.

Jayesh Jotangia represented a doctor who applied through the GMC’s Certificate of Eligibility for Specialist Registration (CESR) application process in the faculty of Plastic Surgery. Having been denied the registration on review, the doctor appealed the decision by instructing Jayesh to draft the grounds of appeal with supporting evidence. 

Before the appeal was formally heard, the GMC conceded and granted Specialist Registration on considering the grounds which had been drafted by Jayesh. The arguments presented were that the doctor did not require the FRCS from England as the qualifications obtained internationally were in fact equivalent pursuant to the statutory test and caselaw. It was also argued that the FRCS was not mandatory, and that research and publications would be near to impossible to gather in every single curriculum component and therefore the important consideration ought to focus on the “outcome” of the international examination as opposed to strict standards settings of the English FRCS Part 2. As a result, the doctor was placed on the Specialist Register via the #CESR route.
