Josh Hitchens successfully applies for “extremely rare” Order in Employment Tribunal

In a five-day Employment Tribunal concerning potential damages of several hundred thousand pounds and several Claimants, Josh Hitchens, instructed by Pattinson & Brewer successfully applied to strike out the Respondent’s Response. Having succeeded on liability, Josh then applied for the “extremely rare” remedy of reinstatement. In 2016-2017, reinstatement was ordered in just 0.033% of Employment Tribunal Cases. Employment Judge Snelson, sitting at the Central London Employment Tribunal, having considered submissions, ordered reinstatement, dismissing the Respondent’s submissions that it was not practicable to do so. This entitled the Claimant to be reinstated in his role and to back pay since his dismissal, in this case a period of two years, totalling a significant sum.
