The Financial Times reported on the latest development in Paul Cohen and Elisabeth Mason's historic US$15 billion arbitration case for the heirs to the Sultan of Sulu against Malaysia.

 

As the FT reported, the Claimants have seized Malaysian assets in Luxembourg potentially worth over US$ 2 billion, as the first part in a campaign to enforce the arbitral award. 

 

Mason stated: “This case is the history of colonialism.  Unlike so many dispossessed, our clients have an ongoing contract since 1878 and, as such, have a path to justice where many others did not.”

 

Cohen said: “International law doesn’t let you pick and choose. Either Malaysia honours its international obligations or it goes ‘full Russia’.  We hope Malaysia will see the cost of being a legal pariah state and come to terms.”

Cremades y Asociados worked as co-counsel in the arbitration with Cohen and Mason in Spain.  Benjamin Siino and François Bordes of GBS Disputes act in recognition proceedings in France.  Véronique Hoffeld and Olivier Marquais of Loyens Loeff serve as counsel in Luxembourg.
