Practice Summary

Patrick is an experienced civil and commercial litigation practitioner specialising in a wide range of disputes. He is adept at blending technical legal skills (as a former specialist solicitor admitted in 1996) and softer skills (as a very experienced commercial mediator) in achieving clients' desired outcomes. Patrick enjoys being involved from the initial stages of a case and developing the whole case strategy. He is comfortable working as part of a team with instructing solicitors or directly instructed under the Public Access Scheme.

Clients include small to medium size SME; particularly building contractors and associated trades. Patrick was admitted as a solicitor in 1996 and moved to the Bar in 2017. He was formerly head of dispute resolution at a regional Legal 500 Law Firm and latterly formed his now specialist law firm dealing exclusively with commercial and civil litigation. He is a very experienced advocate in mediations having represented his own clients on a significant number of occasions and also having been appointed by substantial law firms as sole lead mediator.

Patrick has always enjoyed being part of the legal system and works hard to put his clients in the best position within the process to achieve the best that they can. He will give frank advice. He will advance a case with energy and confidence and be brave. He will be imaginative in bringing solutions to the process. Construction

Patrick has been engaged in construction and building disputes since 1990. Claims have included claims against architects and surveyors for negligent survey and design, claims between employers and contractors for and against payment of sums due under contracts. Patrick has been involved in numerous adjudications under the Construction Act and in proceedings to enforce adjudication awards.

Cases include a valuable arbitration under the Chamber of Commerce of Milan rules.

He is very comfortable with getting into the detail of smaller building dispute type claims between property owners and builders.

Retained as counsel to more than one large construction company.

Patrick brings his considerable skills in ADR to play where appropriate in such cases.

Aviation

Patrick is a qualified CAA Pilot and has an interest in all things related to aviation. He has acted for parties to the sale of aircraft on issues relating to condition and airworthiness and associated warranties and representations. He has acted for repairers advising upon and enforcing lien including negotiating with Liquidators and Trustees.

Patrick also advises a UK Operator on its position in relation to flight delay and procedures to address the impact of E C Regulation 261 / 2004.

Mediation

Although accredited by CEDR in 2001, Patrick was using mediation as part of the litigation process some years before this. Following accreditation, he has developed a significant practice as a mediator and is a member of a number of recognised Panels. Overall he has been involved in several hundred mediations in one capacity or another. The subject matter and value of these claims vary greatly - from low financial value but tricky disputes (often involving individual parties who are sometimes unrepresented) to multi party disputes of a greater sum. Many firms of solicitors turn to Patrick again and again as their first choice of mediator.

International Arbitration

Patrick has been involved in a small number or arbitrations under the Milan Chamber of Commerce Rules, AAA and ad hoc. He is an Associate Member of the Chartered Institute of Arbitrators.
