Practice Summary

Rajdeep specialises in commercial litigation and international commercial arbitration, with over 20 years’ experience in representing businesses in disputes arising out of a range of industries including oil and gas, renewable energy, power, infrastructure, manufacturing and commodities. He represents all key stakeholders such as project sponsors, contractors, shareholders and offtakers.

He has advised a national oil company in an investigation arising out of its participating interest in a production sharing contract.

In commercial litigation, Rajdeep appears in all High Courts in India and the Supreme Court of India.

In international commercial arbitration, he appears in ad hoc and institutional arbitrations seated in and outside India governed by the (Indian) Arbitration and Conciliation Act, 1996 and all the main rules, including those of Singapore International Arbitration Centre, International Chamber of Commerce, London Court of International Arbitration, Hong Kong International Arbitration Centre and Dubai International Arbitration Centre.

In disputes arising out of construction contracts, Rajdeep also appears before Dispute Adjudication Board and Dispute Avoidance/ Adjudication Board.

Rajdeep’s understanding of technical aspects of disputes coupled with his industry knowledge and effective oral and written advocacy equips him to present clients’ positions to courts and tribunals persuasively.

He accepts appointment as arbitrator, and is on the panel of arbitrators of Hong Kong International Arbitration Centre and Asian International Arbitration Centre.

Rajdeep was called to the Bar by Lincoln’s Inn in 2001 and was enrolled with the Bar Council of West Bengal (India) in 2005. When studying for the Bar Vocational Course, he was the recipient of the Sir Thomas More award by Lincoln’s Inn. Rajdeep has written extensively on arbitration law and contract law. He is a regular speaker at conferences.

Outside of work, Rajdeep is an avid runner and motorcycle enthusiast.

Advising a major EPC contractor in relation to claims arising out of a contract based on the FIDIC Red Book (1999) for the construction of viaducts and stations for a multilateral development bank-funded metro rail project in India.

Acting for a major EPC contractor in a Singapore-seated international commercial arbitration under the rules of the ICC arising out of a FIDIC Yellow Book (1999) contract for the design and installation of works at a railway freight project.

Acted for a solar power producer in an international commercial arbitration seated in Singapore under the rules of SIAC arising out of a contract for solar PV modules, where the proper law of the contract was Singaporean law.

Acted for a wind power producer in an India-seated ad hoc arbitration in relation to a procurement contract with a wind turbine manufacturer.

Acted for a major SOE in international commercial arbitrations seated in England and Dubai under UNCITRAL rules arising out of oil production and transportation projects in Africa, where the proper law of the contract was English law.

Acted for an Indo-Korean joint venture in an India-seated ad hoc arbitration arising out of contracts for construction of strategic oil reserve storage caverns in India.

Advised a European oil and gas company in relation to disputes arising out of a production sharing contract and a joint operating agreement for onshore oil fields in India.

Acted as sole arbitrator in an India-seated ad hoc arbitration arising out of an automobile distributorship agreement.

Acted as sole arbitrator in an India-seated ad hoc arbitration arising out a suite of financing agreements.

Acted as sole arbitrator in an India-seated ad hoc arbitration arising out of a commercial lease.
