Practice Summary

Rayan specialises in property litigation with a particular focus on leasehold disputes and claims pursuant to the Trusts of Land and Appointment of Trustees Act 1996 involving resulting/constructive trusts. Rayan has experience in the Upper Tribunal and regularly appears in the First-Tier Tribunal and the County Court in the full range of landlord and tenant matters.

Rayan is also experienced in commercial litigation and is regularly instructed to represent in matters pertaining to contract disputes. Her clients range from individuals to large governmental bodies and she has previously been instructed by the Federal Inland Revenue Service of Nigeria (FIRS) in an application to discharge an interim Third Party Debt Order (iTPDO) relating to an arbitration award of approximately £14 million (Rayan was led by David Quest QC).

Landlord & Tenant

Rayan acts for landlords, tenants and managing agents in the full range of leasehold disputes including forfeiture, service and administration charges, enfranchisement, breach of covenant and right to manage. Rayan is praised for being imaginative and robust in her approach to cases.

Real Property

Rayan acts for clients in all areas of property law. She has a particular interest in constructive/resulting trusts and claims pursuant to the Trusts of Land and Appointment of Trustees Act 1996. Rayan is called upon to provide advice at the initial stages, draft pleadings and represent at trials.

Commercial

Rayan has a busy commercial practice acting for clients in matters involving contractual disputes.

Rayan was recently successful in a multitrack building dispute which involved skilful and thorough cross-examination based on a variety of financial statements.

Rayan was also instructed as in-house counsel to act for the successful Defendant and Third-Party in a multi-track multi-million pound commercial dispute (Rollerteam Ltd & Others v Linda Riley [2015] EWHC 1545 (Ch): Declarations of trust; Enforcement; Formalities; Formation of contract; Intention to create legal relations; Part performance; Settlement; Validity).

Housing and Property

Rayan accepts instructions from landlords and tenants (private and social sector) and represents clients regularly in possession proceedings. Rayan has had experience in making and resisting applications for possession, set aside applications, warrant suspensions, unlawful eviction, anti-social behaviour, succession, disrepair and public law defences.

International Arbitration

Rayan represented an investor in two multi-million pound (ICSID) investment treaty

arbitrations against the Republic of Zimbabwe whilst working at international
law firm, Steptoe & Johnson.

Rayan accepts instructions directly from organisations, companies and members of the public.

Other

Prior to coming to the Bar, Rayan worked at international law firm Steptoe & Johnson on two multi-million pound (ICSID) investment treaty arbitrations against the Republic of Zimbabwe. Rayan also interned at the United Nations High Commissioner for Refugees in Geneva and assisted in an amicus curiae brief in the UK Court of Appeal.

In her spare time, Rayan enjoys travelling, horse riding and watching documentaries.
