County Court rules PA Housing’s Section 21 eviction notice invalid in landmark decision
In a significant judgment issued on 25 October 2025, a county court at Leicester has overturned a possession order against a tenant of Paragon Asra Housing — finding that the social landlord’s Section 21 notice was “invalid.”
The case — Paragon Asra Housing v Rainford — concerned a “starter tenancy” that had been extended and a Section 21 notice served requiring the tenant to leave before the fixed-term tenancy expired. The court held that because the Section 21 notice gave a “leave-after” date that fell within the fixed term, it was misleading and failed to reflect the landlord’s true entitlement under the relevant law. As a result, the notice did not meet statutory requirements and was invalid.
The judgment, delivered by HHJ Hedley, overturns a first-instance possession order — a rare outcome for a social landlord.
