Jonathan Manning instructed on important Judicial Review

Jonathan Manning is instructed on an important judicial review of the decision by the Secretary of State for Justice and HM Prisons and Probation Service to transfer a dangerous offender to an open prison. 

S viciously attacked D in 2015. Whilst on remand, S continued to attempt to contact D and her family members leading to a further conviction for witness intimidation. It is the Claimant’s case that S had previously subjected other women to serious domestic violence.

The Claimant argues that the decision to transfer S to an open prison places her in danger and breaches the UK’s positive obligations under Article 2 and 3 of the European Convention on Human Rights and is unlawful on a number of other grounds.
