Kevin Brown successfully represented the claimant company in a commercial landlord and tenant dispute over unpaid rent, securing money judgment of over £60,000 plus costs for the client.
Metro Properties Ltd granted a tenancy to Kuklous Ltd for a large London property with annex which the defendant company intended to sub-let. After a two-day trial on the intermediate track, the County Court found that on proper construction of the agreement, the tenant was obliged to pay rent despite vacant possession of the annex not being delivered by the expressed deadline. Vacant possession was later obtained but rent arrears continued to accrue until the lease was forfeited and the tenant gave back possession. The claim was therefore allowed and the Court awarded the entire sum claimed for rent and mesne profits, in addition to significant interest pursuant to the County Courts Act 1984.
The defendant’s counterclaim for alleged damages to business profits and reputation, and the cost of modifications to the property, was dismissed.
