The Court of Appeal today handed down judgment in the case of Tortoise Media v Conservative Party [2025] EWCA Civ 673.

What is a public function? Does a political party, when choosing a leader, perform a public function for the purpose of judicial review or the Human Rights Act 1998? The Court of Appeal unequivocally stated that the choice or election of such a leader is not a public function; it is, in short, a matter for the party, in this case the Conservative Party.
