Alazye v Westminster City Council

Annabel Steele acted for the appellant in an appeal under s.204A, Housing Act 1996 against the local authority's decision not to provide accommodation pending the main s.204 appeal. The case has featured in this month's issue of LAG Magazine.

The case concerned an appeal under s.204A of the Housing Act 1996 against a local authority's decision not to provide accommodation pending the determination of a substantive homelessness appeal under s.204.

Although the appeal was dismissed, the appellant successfully resisted an argument that it had been brought out of time. HHJ Holmes held that s.204A contains its own time limit requiring an appeal to be brought before the determination of the main s.204 appeal, meaning the usual 21-day limit did not apply.
