Health and safety offences can be prosecuted by:
· The Health and Safety Executive.
· A Local Authority.
· Any other enforcement body that is empowered by health and safety regulations to bring a prosecution for a breach.
If a workplace safety breach results in death, a person can be prosecuted for gross negligence manslaughter. An organisation can also be prosecuted for corporate manslaughter under the Corporate Manslaughter and Corporate Homicide Act 2007. These offences are investigated and prosecuted by the police and Crown Prosecution Service (CPS). However, as specialists in health and safety law and practice, the HSE is likely to have a role in such investigations.
