Jane Lambert, member of 4–5 Gray's Inn Square has written an article examining the significant Supreme Court judgment in Tesla, Inc and another v InterDigital Patent Holdings, Inc and others [2026] UKSC 27.

The case raises important questions surrounding Standard Essential Patents (SEPs), FRAND licensing and the jurisdiction of the courts of England and Wales.

The Supreme Court allowed Tesla’s appeal, concluding that there is a serious issue to be tried as to whether the FRAND obligation applies where SEP owners offer licences jointly through a licensing platform, and whether a platform licence at a FRAND rate may be appropriate.

Jane provides an insightful analysis of the judgment, its background and the key issues considered by the Supreme Court, as well as what the decision could mean for SEP owners, implementers and licensing platforms.
