Mediation & legal costs disputes: still underused?
Concerns about excessive legal costs are nothing new - Dickens was writing about them in Bleak House. Yet recent cases show the issue is still very much alive, with courts describing some projected litigation costs as “manifestly excessive”.
In a recent article, Patrick Taylor and Arran Dowling-Hussey highlight an often overlooked point: costs disputes themselves can be mediated.
Mediation can offer a faster, more cost-effective and less adversarial way to resolve disagreements over costs, avoiding the delay and uncertainty of a contested hearing. With high success rates and the ability to arrange mediations quickly, it remains an option that is arguably still underused.
ADR should not only be considered for resolving the substantive dispute but the costs dispute as well.
