Reform of the 1996 Arbitration Act: What To Expect - Caroline Kenny KC and Arran Dowling Hussey

The UK's Arbitration Act 1996 is set for its first major update in decades. The UK Law Commission recently wrapped up a review of the legislation, which governs arbitration proceedings in England, Wales, and Northern Ireland. The Commission aims to modernize the Act through practical changes based on current best practices. Proposed revisions include clarifying arbitrators' duties, enhancing tribunal powers, addressing impartiality issues, and updating provisions around appeals and enforcement. While awaiting legislative enactment, the recommendations are seen as pragmatic steps to keep pace with a changing arbitration landscape.
