This article provides an overview of the legal principles applied when a landlord seeks possession on the basis that a tenant no longer occupies a property as their only or principal home. It examines the Court of Appeal's guidance in London Borough of Islington v Boyle [2011] EWCA Civ 1450, alongside key cases in which possession was refused, offering practical insight into how the courts determine whether a tenant has retained security of tenure under the Housing Acts 1985 and 1988.
