Peter Saville

He advises charities and unincorporated societies on:

·       Interpretation of founding articles and governing documents;

·       Charities Legislation;

·       Altering articles – including contentious and non-contentious variations.

His recent charity work includes:

·       Acting in litigation on behalf of an unincorporated society in the interpretation of its trust deeds in ongoing High Court proceedings due to be heard in the Business and Property Courts in 2026.

·       Successfully removing a national charity as a party to proceedings  under the Public Trustee Act 1906 in an action for Rylands and Fletcher nuisance

·       Advising a national charity on the construction of trust documents in respect of land and application to the Charity Commission for a Cy-près scheme.

Peter regularly advises and acts on behalf of individuals and organisations in traditional chancery matters. He accepts instructions in all areas of traditional chancery work such as:

·       Trustee appointment and removal;

·       The administration of estates;

·       Advising on litigation or administration as a result of incapacity;

·       Wills and Probate work

·       Claims for provision under the Inheritance (Provision for Family and Dependants) Act 1975.

Peter acts on behalf of companies and their directors in litigation and in anticipation of litigation. Peter is able to advise on company law and the duties of directors, and on corporate debt recovery and enforcement.

He also acts on behalf of companies in the Insolvency and Companies Court and has experience representing their interests in winding up petitions, rescission hearings and validation order applications.

Peter accepts instructions in:

·       Contractual disputes;

·       Director’s duties and liabilities;

·       Allegations of breach of fiduciary duties;

·       Corporate Finance disputes;

·       Data Protection Act litigation on behalf of Companies and institutions;

·       Enforcement in the High Court and county court.

Peter recently represented the director of a company in a construction dispute being sued in person after the company’s liquidation.

Peter has acted on behalf of Regulators and on behalf of individuals in investigations and litigation concerning the provision of Financial Services.

Recent experience includes:

·       Applying FSMA 2000 in the context of broader civil fraud litigation on behalf of an individual concerned with endorsing crypto currency trading;

·       Advising the Office for Financial Sanctions Implementation (HM Treasury) in an investigation regarding breach of the Russia (Sanctions) (EU Exit) Regulations 2019 by an international bank.

·       Secondment to an FCA to advise on an investigation into the mis-selling of microbonds following the London Capital Finance Litigation.

Peter appears in the Court of Protection and has previously been instructed by the Office of the Public Guardian. Peter welcomes instruction in Property and Financial Affairs matters.

Peter has developed a busy Ecclesiastical practice and has experience of Clergy Discipline and Faculty work. He is regularly instructed to act as the Proctor in the Church in Wales the role’s requirement of case preparation and presentation means Peter has a unique perspective in the strategic approach to Ecclesiastical Discipline cases.

Recent instructions include:

·    In the Matter of the Reverend Ryan Forey (2025) – A rare prosecution of Trustee misconduct and secession in the ecclesiastical courts. Peter acted as the Proctor throughout proceedings. ·    In the Matter of JB (2024) – Acting as Proctor in a contested penalty hearing within the Church in Wales.

·    Advising a statutory consultee in a faculty petition against the removal of pews from a historic parish church.
