Peter Saville successfully represented the Commissioner of Police for the Metropolis
Rapper Nathan Tokosi has been found guilty of attempted murder after a trial at the Old Bailey. Mr Tokosi, a rapper also known as DigDat, was found to be one of the individuals who fired 6 shots at a man in Nottinghill. DNA evidence connected Mr Tokosi with the vehicle used for the shootings and was the subject of Judicial Review Proceedings where the Defence argued the Metropolitan Police did not have the power under the Police and Criminal Evidence Act 1984 (PACE) to collect further DNA samples from Mr Tokosi without his consent.
Peter Saville successfully represented the Commissioner of Police for the Metropolis at the Permission stage of the Judicial Review where the High Court refused Mr Tokosi permission to challenge the decision of officers to seek involuntary samples, and discharged an injunction prohibiting samples being taken.
The DNA evidence then collected went on to become a central feature of the Old Bailey trial.
