London sees growth in Family Law Arbitration
Family Law Arbitration:
In a new article, Tessa-Jade Heise and Arran Dowling-Hussey examine the growing use of Family Law Arbitration in England & Wales.
While Family Law Arbitration was not seen before 2012 and has taken some time to gain traction, there has been a notable increase in its use in recent years.
The article highlights:
• The recent growth from a low base of Family Law Arbitrations in London to a near 50% increase.
• Two distinct schemes for financial remedies and disputes have been dealt with since 2012, with arrangements with children being introduced in 2016;
• Arbitration provides privacy for separated couples and saves media reporting about alleged habits and spending that can follow family law court hearings;
The key takeaway:
Although Family Law Arbitration still represents a small proportion of the approximately 100,000 divorces each year in England & Wales, its use is increasing and is expected to grow as parties turn to private and efficient dispute resolution.
